New Build vs Resale Property in Spain: Which Is Better in 2026?

You have found two Spanish properties within roughly the same budget. One is a new-build apartment with modern specifications, a communal pool and a completion date in the future. The other is an established resale home that you could potentially move into much sooner.

Which one is actually the better buy?

For international buyers, the answer depends on much more than whether you prefer a modern kitchen or a traditional neighbourhood. New-build and resale properties have different tax treatment, payment schedules, legal checks, timelines and ownership considerations.

The best way to compare them is to use real properties, real locations and the total cost of ownership, rather than relying on generic assumptions.

A new-build property is generally a home being sold for the first time by the developer. It may be under construction, sold off-plan or already completed.

A resale is an existing property being purchased from its current owner.

That distinction affects both the buying process and taxation. The Spanish Tax Agency confirms that the first delivery of a new home by a developer is generally subject to VAT, while used homes are generally subject to regional Transfer Tax, or ITP. The general VAT rate on a qualifying new residential property is currently 10%.

This means it is inaccurate to assume that a new build automatically has "lower purchase tax". The final tax position depends on the property, transaction and autonomous community.

This illustrates one of the main new-build trade-offs. You are buying a modern home with contemporary communal facilities, but the property is not an immediate move-in purchase.

Resale Example: Alamar, La Cala de Mijas

Propuno also currently lists a two-bedroom, two-bathroom resale apartment in Alamar for €365,000.

The apartment provides approximately 90 m² of living space plus a 30 m² south-facing terrace. It is sold furnished and is within a gated community with a communal pool, landscaped gardens, padel court and year-round concierge.

The listing places Lidl approximately 150 metres away and central La Cala around 500 metres from the property.

The asking prices are relatively close, but these are very different purchases.

The Célere Delmar buyer is accepting a future completion date in return for a new home and new-build specification. The Alamar buyer is considering an established community where the apartment, neighbourhood, amenities and communal areas can already be inspected.

That is a far more useful comparison than simply saying "new builds cost more".

What You Get With a New Build

The strongest argument for a new build is certainty around the specification you are buying into.

Modern developments are designed under current construction requirements and often incorporate features such as open-plan layouts, large terraces, contemporary glazing, communal leisure facilities and modern heating or cooling systems.

What Buyers Should Check With a New Build

Off-plan purchases require a different type of due diligence from resale properties.

Your independent lawyer should examine the developer, contract, planning position, payment arrangements, completion documentation and protections applying to any funds paid before completion.

Buyers should also understand exactly what is included.

Parking, storage, appliances, air conditioning, furniture packages, landscaping and private pools should never be assumed simply because they appear in marketing imagery.

The completion date matters too.

A buyer who needs a Spanish home this winter should not compare an off-plan property completing in 2028 with an immediately available resale as though they solve the same problem.

New-Build Warranty Protection: What the Law Actually Says

New homes do benefit from statutory protections, but "10-year guarantee" is an oversimplification.

Spain's Building Act establishes different liability periods depending on the type of defect. Structural defects affecting mechanical resistance and stability can fall within a 10-year period, defects affecting habitability within a three-year period, and certain execution or finishing defects within a one-year period.

That does not mean every problem arising during ten years is automatically covered.

Your solicitor should explain the documentation and protections applying to the particular development you are considering.

What You Get With a Resale Property

A resale lets you assess much more of the finished product before committing.

You can see the actual view rather than an architectural rendering. You can inspect the communal gardens, hear nearby traffic, walk to the supermarket, check how much afternoon sun reaches the terrace and see whether neighbouring properties are occupied.

Established areas also provide more evidence about how the location functions in real life.

What Buyers Should Check With a Resale

The fact that a property already exists does not remove risk.

Your solicitor should confirm legal ownership, registered charges, community debts, planning status and relevant municipal documentation.

The physical condition also deserves careful attention.

Look beyond paint and furniture. Air conditioning, windows, plumbing, electrical systems, waterproofing, communal lifts, façades and roofs can materially affect future expenditure.

Ask for the latest community accounts, minutes and information about planned extraordinary charges where applicable.

A lower asking price can quickly lose its advantage if major communal work or extensive renovation is required after completion.

Purchase Tax: Do Not Choose Based on a Headline Percentage

This is one of the biggest weaknesses in generic new-build versus resale comparisons.

New homes purchased as qualifying first deliveries generally carry 10% VAT. Stamp Duty, or AJD, can also apply and varies regionally.

Resale homes generally attract ITP, with the rate determined by the autonomous community.

For example, the general ITP rate in Andalucía is currently 7%, while the final cost of a new-build transaction also needs to account for VAT and applicable AJD.

That means the correct question is not:

"Which one has the lowest tax?"

It is:

"What is the complete acquisition cost of these two specific properties?"

Energy Efficiency: Compare Certificates, Not Assumptions

Modern construction can offer better insulation, glazing and energy systems than older housing stock, but buyers should avoid assuming that every new property has an A rating or that every resale performs poorly.

Spain requires energy performance documentation in property transactions.

Ask for the actual energy certificate and compare the homes you are considering.

With a resale, also look at improvements that may already have been completed. Replaced windows, modern air conditioning, solar systems or upgraded insulation can materially change the performance of an older property.

The certificate is more useful than relying on the building's age alone.

Financing New Builds and Resales

Mortgage availability depends on the buyer, lender and property.

The practical difference with an off-plan purchase is timing.

A buyer may need to make reservation and staged payments before the mortgage is finally drawn at completion. That makes cash-flow planning particularly important.

With a completed resale, the buying and financing timetable is generally concentrated around the transaction itself.

International buyers should therefore seek mortgage guidance early rather than reserving a property and only then checking whether the required financing is available.

Is Spain's Golden Visa Still Available in 2026?

No.

This is an important correction to older Spanish property guides.

Spain's property-linked Golden Visa route ended in April 2025. Buying a new build or resale property worth €500,000 or more does not provide a new buyer with Golden Visa residency in 2026. There is no universal winner.

A new build is more likely to suit you if you value modern specification, contemporary communal facilities, lower initial maintenance requirements and are comfortable with the development's payment and completion timetable.

A resale may suit you better if you want to see exactly what you are buying, prefer an established location, need quicker occupation or want access to housing stock in areas where little new construction remains.

The crucial comparison is between specific properties.

A €357,700 new-build home completing in 2028 and a €365,000 established apartment available in La Cala today may sit in a similar price range, but they solve completely different buyer needs.

That is why your shortlist should begin with intended use, timeframe and total budget rather than property age.
